Well considering that the factory makes about 100,000 of each of these guys I'm surprised it doesn't happen more often. Still, you can always just return it. I think there's a number you can call too if you want to let Mattel know personally of the problem.

Als, there's such a thing as factory errors and deliberately shanking the details...ie TTL arms on RA bodies, half painted designs to "cut costs", etc

DC Universe has some similar issues with quality. I like the figures, though and have not personally gotten a DC Universe figure that was messed up...yet.
