i just finished my smart serve course, so i know for a fact one can sue the bar they were drinking at for their actions afterward. i don't agree with it, but that's how it is. it's happening in the town i'm living in right now.
and what you described in the first response is literally the definition of aggravated assault.

I'd love to see an example of someone who successfully sued a bar because they got overserved. In a lot of states, the victim of an assault committed by an overserved patron can sue the bar, but I've never heard of a single case of a drunk guy going out, picking a fight, getting injured, and successfully suing a bar. You might need to research that further. If it was Daivari threatening people on the light rail, then attacking them (causing serious injury), THAT is aggravated assault. But if you threaten me and I am in reasonable fear for my safety, I'm within my rights to defend myself. Daivari didn't put the guy in the hospital or cause him any serious injury. The RNC restrained the guy more than it actually hurt him. The fact that the police asked the WITNESSES if they wanted to press charges against the drunk guy (and not the drunk guy himself) is a pretty clear indication that he shouldn't bother suing anybody.

After watching this i have to say i think Daivari handled it just fine. Drunks can be extremley scary. You do know they don't pat you down while taking public transpiration right? This guy could of had a gun, a knife anything. There's no reasoning with guys like that. He was hurling racial insults and eventually started with death threats. An emergency button was pushed AND the article says the conductor was "watching"the situation the entire time. Still no one intervened. Sure the kick was a little much id blame it on the adrenaline. The guy was obviously fine afterwards. He's lucky he only with a few scatches and pair a pants full of sh*t. Dumb ass drunk.

Keep in mind, the passengers felt threatened enough to push the emergency button. Daivari choking him out is fine. I understand why he needed help, the dude looked like he was 250+ and Daivari is 190. But, come on, dude, why the hell did you kick him? Unless he was like grabbing his leg or something and Shawn was trying to get him off or something.

I think it's funny that you guys think Davari is a bad ass or a hero for beating up a drunk guy. The guy was drunk and running his mouth off. He did nothing . There's a good life lesson here. If you are a drunk, especially a mean one, keep your butt at home. Don't ruin other people's days by making threats and doing all the other ridiculous stuff that comes with being drunk. The only people that did anything wrong here are the police. He should be charged with public intoxication, disorderly conduct, and making terroristic threats. A few weeks in jail and a few thousand dollars in fines should drive home the point that Daivari already made.

the whole thing about the conductor watching it sounds like pure bull and they're just covering for how they provided 0 help to the scenario.
