As an Intellectual Property attorney, I can tell you that it's a lot more complicated than most of you realize. I literally could write like a 20 page paper explaining all of the issues with it, but I'll spare you.
The best name for Cody to go by would be Cody Star (a play on his Cody Rhodes and Stardust characters). Plus Cody Star at least sounds like a wrestling (and porn) name hahah

Yeah I'd say he should just legally change his name. The funniest/craptiest part in the whole thing is that his wife can be in TNA as Brandi Rhodes because the WWE doesn't own the trademark to that name. That's because you actually have to use or have an intent to use the name to get a trademark on it. They weren't ever planning on calling her Brandi Rhodes, so they would never be granted a trademark on it.

He didn't "allow" WWE to do anything. He was a homegrown WWE developmental kid in his early 20s when he started. What is WWE going to do with the name "Cody Rhodes" anyway? It's not like they would just pluck out a random wrestler and name them "Cody Rhodes". Yes it's their copyright and they're free to do what they want with it. And as holders of the copyright they SHOULD allow Cody to use the name Cody Rhodes as a show of good faith and out of respect for Dusty. because the company already screwed him over once, it's screwing him over double if he isn't allowed to use the brand that made him famous. It's harming his earning potential. If he and Brandi had kids, they'd basically be taking food out of their mouths doing that ish. Cody had nine years to discuss obtaining the copyright / trademark for his name and more than likely could have worked something out with the company. Please spare the idea that WWE are taking food out of his hypothetical children's mouths and harming his earning potential when 99.9% of his indie bookings have been promoted using the "Cody Rhodes" name. Ring of Honor is promoting him as "Cody Rhodes" for Final Battle. Pro Wrestling Guerrilla advertised him as "Cody Rhodes" for BOLA. Northeast Wrestling advertised him as "Cody Rhodes" for his first appearances and also for his upcoming appearance. The fact that WWE has not sent letters telling these companies to f*** off advertising him as such is the only "good faith" that Cody Rhodes is getting. You are more than welcome to think WWE is in the wrong but I'm okay with them keeping the copyright / trademark until it's expiration. If Cody wants the name so bad.. sue 'em for it. The copyright won't expire until the WWE (who I assumed is listed as the author on their federal registration) goes out of business + 70+ years (I don't know the time length off the top of my head, it may be as much as 9). Trademark expires whenever WWE stops using cody's likeness and referring to him as Cody Rhodes in anything that's in commerce. So with the WWE network in place, probably not for a while. But it's likely WWE will stop paying maintenance fees and then the trademark will go "dead"/"abandoned" in a few years. tmsearch.uspto.gov/bin/showfield?f=doc&state=4807:2zdezn.2.1The reason WWE isn't going after these companies to shut them down is because they want to keep a good relationship with Cody/Dusty's family...Cody asked for his release, they didn't choose to fire him. Anytime WWE goes to court with a former wrestler it's trouble and burns a major bridge. WWE is cognizant that Cody may go elsewhere and develop a huge fan base and in a year or 2 be someone they want to sign and push to the moon, so strategically the best thing to do is to remain on good terms. Further, big company's never go on the offensive litigation wise against other wrestling companies unless there has been a serious violation of their rights (see WCW v. WWE; and in that case it was because WCW was misrepresenting Nash and Hall as being aligned with the WWE and thus causing consumer confusion). WWE doesn't care about monetary damages, they would want an injunction...no court is going to prevent Cody from wrestling under that moniker (Stardust yes, Cody no). Then as soon as Cody wins in court, then literally every single other wrestler brings their case. A big part of this is just industry standards and precedent, regardless of how WWE actually feels. As soon as WWE makes an exception for one guy they need to start making exceptions for everyone. WWE files registrations on their trademarks and copyrights in probably 100 countries. The transaction costs and time it would take to just transfer it and work out all the issue with licensing and everything would cost a small fortune and take a long time.

I haven't followed wrestling in a long time so I wouldn't know, but from what I remember she used that name in untelevised stuff and only a few times. You have to be using the name continuously in commerce to receive and maintain an enforceable trademark. But based on how the Cody Rhodes trademark's first use in commerce is listed as the night he debuted on Raw (7/2/07), I'd assume that factored into it. WWE's strategy when it comes to IP (pretty much for it's entire existence except for the late 90's and early 00's when "reality" was in) is to always choose something more distinctive and different than the superstars real name, so as not to even remotely cause consumer confusion between the character and the real person. Granted Randy Orton, John Cena, and Brock Lesnar all go by their real names...but that was a totally different era when those guys came up. Heck even Batista uses a different spelling of his real last name (also technically his real name is Bau [Baw-tista] and his WWE name Ba [Bah] tista...but tomato tomato).
