I recently saw a poster for a show with Emma advertised as, well, Emma. I thought it was strange because she's gone by her real name since being released. I figured that out was a either a mistake or the promoter hoping that WWE won't find out and/or sue but I'm asking you guys in case maybe she worked out some kind or deal with the McMahon Machine to use that name that I hadn't heard of.
Probably not but crazier things have happened.

All WWE talent can use their WWE names on non-televised events, if I'm not mistaken.
That's why Rhodes is only referred to as "Cody" on ROH, Impact and NJPW shows and "Cody Rhodes" at the rest of his indies.

The copyright also expries and the talent can then purchase the rights to the name.

All WWE talent can use their WWE names on non-televised events, if I'm not mistaken. That's why Rhodes is only referred to as "Cody" on ROH, Impact and NJPW shows and "Cody Rhodes" at the rest of his indies. I think Cody Rhodes also said that he probably could used “Cody Rhodes” on TV if he called WWE and asked, but it wasn’t worth the hassle to him. I think Bruce Prichard also said that a lot of cease and desist letters go out from WWE’s legal team without checking with Vince. I kinda remember him saying that the cease and desists are kinda just like interns sending them out for anything that is a violation, and often wrestlers can call and request permission and at that point they’ll decide if it’s worth letting the person continue using the IP. In Emma’s situation, either WWE isn’t aware yet, or they figure her using the Emma name on an indy show won’t really hurt them.

A few local shows have had wrestlers from WWE. When they advertise it's usually in itty bitty writing "F/K/A WWE Superstar" and then in big letters their WWE moniker. Maybe that was done with Emma in this case? She usually goes by Tenille Dashwood or whatever her real name is.

Why would you want to? Tenille Dashwood is an awesome name. True. But if the company is trying to draw local people that only know WWE, they would want to feature a WWE superstar.

Sounds like the company wants to force the WWE name into their show. If they are a small company, it gets a bye. But, if the company gets some traction and views/hits, they'll get a letter from WWE. Same thing, if they use a picture from a WWE photographer; WWE will write a complaint to start the legal process.

A lot of independent promotions that use former WWE talent put their WWE names on the posters/flyers to get more people to come see them. Usually they do it as like "FKA WWE's ____" or "Former WWE Superstar ____" so they can avoid copyright stuff.
Although, according to Simon Gotch, WWE let the trademark on his name lapse so he bought the trademark recently, maybe Tenille/Emma did the same.
