This Legacy would be better than the original, it would be born better, bred better, and overall better than the original Legacy stable in every way possible, and instead of 3 members it would have 4 members:
Randy Orton turning heel again (Leader; 3rd generation superstar)
Husky Harris (Enforcer; 3rd generation superstar)
Michael Mcgillicutty (3rd generation superstar)
Brett DiBiase (Ted's little brother, 3rd generation superstar)

Ortons made himself a bad ass character, it would ruin him having to hide behind people again. A group where each individual is a legitimate bad ass, hungry and wanting to be dominate with Orton as the main guy could work.

How about Ted DiBiase Jr. is the new leader for the New Legacy and that Ted drops this whole Fortunate Son gimmick and he goes back to his Legacy gimmick but that Ted is the leader and you build him up to be like an Orton and have Ted become a main eventer winning match after match until he is in contention for the WWE Title on RAW and then Ted is the leader for New Legacy

Cody dropping the Dashing gimmick and going to a Legacy gimmick would be a major step back.

How do you figure? If Cody drops his Dashing gimmick and goes back to his Legacy gimmick, it would make him more credible to be in this New Legacy stable, and he would be Ted's right hand man as Ted would be the leader, and then add Mcgillicutty and Harris in there, they would be the 2 young stallions of this group and DiBiase & Rhodes take them under their wing with Ted eventually becoming WWE Champion, Rhodes as United States Champion, and Mcgillicutty & Harris as WWE Tag Team Champions, all on RAW for next year, please make it happen

Randy Orton is above and beyond this. If anything, Dibiase should start his own stable.

Exactly and DiBiase would be starting his own stable but with this New Legacy idea that I have cooked up, this time Randy Orton would not be the leader, he wouldn't even be in it, Ted would be the Leader of New Legacy. Ted at the helm being the main eventer of the stable being in contention for the WWE Title, with Cody Rhodes as his right hand man dropping the Dashing gimmick, and then you add Harris and Mcgillicutty and you're all set

If they re-did legacy, or did a similar spin off, how about bringing in Barry Windham in a managerial role with David Hart Smith as his client?

Michael Mcgillicutty (3rd generation superstar; Son of the late great Mr. Perfect Curt Hennig & grandson of Larry "The Axe" Hennig)
Donny Marlow (currently in FCW right now) (2nd generation superstar; Son of WWE legend and WCW legend Haku)
They can be a real super-group on RAW years from now with Ted dropping Maryse as his valet, and Ted DiBiase develops a real mean streak, an aggresiveness we have never seen before and Ted ends up on a huge winning streak winning match after match and then ends up being #1 Contender for the WWE Championship by winning a battle royal, let's say, and at the PPV while he has his championship match, DH Smith out of nowhere comes into the ring and lays out the WWE Champion whoever it is, and helps DiBiase to win the WWE Title and they end up shaking hands and raising each other's hands. Then the next night on RAW, Ted claims that not only is he the new WWE Champion but that he is going to start his own group on RAW and that this group will be very similar to Legacy but that it won't be Orton's Legacy, it will be my Legacy, and my Legacy will be better than the original ever was and that this group will be more exciting and more better than the Legacy he was in where he was held back. Then Ted invites DH Smith to come out and join The New Legacy and DH Smith does. Then Ted and DH Smith start to scout potential members for this new group, and they choose Mcgillicutty to join and Mcgillicutty eventually joins their group after helping DH Smith in a match-up from out of nowhere, and Ted likes what he sees, inducting Mcgillicutty into The New Legacy. That makes 3 members now, and for the 4th member Donny Marlow how he joins is similar to how DH Smith joins but that he causes a distraction for whoever Ted is facing for the WWE Championship, causing Ted to hit Dream Street on his opponent, and Donny Marlow gets in there with Ted DiBiase. It looks like Donny is about to attack DiBiase but Smith & Mcgillicutty come out to save Ted, but Donny has a smile on his face, and he hugs DiBiase, Smith, and Mcgillicutty shaking all their hands, and the four of them raise their hands in victory of what they have done.
That is how your New Legacy would be formed, with 4 members this time

The 2nd/3rd Generation thing lost its kick. Somebody like Orton is too big of a name to be piled in with a bunch of smucks. Really what I would have liked to seen was DiBiase, Rhodes, Harris (Going by his name Wyndham Rotunda), Joe Hennig, DH Smith to all be basically jobbers to main stars. Get hyped up "oh this is the son of so and so trying to add to the family legacy by beatin Cena, Triple H etc for a title and basically being squashed. The at one point they all join forces as one big Generations stable to take what they think is "deserved" to them because of their name. Something along those lines.
