It was a little complicated since WWE was one of ECW's creditors in the bankruptcy proceedings... so they were entitled to something. The problem was ECW had a TON of creditors and WWE wasn't even close to the biggest one (which I think was Acclaim). So while WWE was owed something, it wasn't up to them to just freely use the logo/trademarks to recoup their own losses without waiting for the courts to decide who got what.
WWE did get what they wanted in the end, but I'm pretty sure they had to approach Acclaim, etc. to purchase them after the settlement. WWE wasn't a big enough creditor to have won all of the rights in court, but those who were, were certainly more interested in selling to WWE than in hanging on to it and trying to monetize it themselves.
