I have had the same problem at walmart and target and i was talking to a manager both times who them put the figures back out. The manager at kmart even had the nerve to add a oh well

I was at Target last month, a guy returning an Elite with a Basic figure (think it was CM Punk). Staff meticulously checked the item, spotted the discrepancy, and raised the alarm. But guy was an ass, claiming he bought the switcheroo in the first place. After arguing 5 min, staff gave in due to "customer is always right" and also guy was becoming aggressive. Sad but true.

For a while I always brought this stuff up to customer service, but with the exception of one TRU manager, no one has cared, and the stuff ends up back on the shelf the next day, so I've sort of given up. Recently I was at a TRU Express and had stumbled across some repacks, and I wasn't gonna say anything, but right then the manager asked me if she could help me with anything, so I told her what was up, and she pretended to take the items off the shelf. (I forget what it was, but I think it was also a CM Punk...maybe an Elite 16...that had been swapped.) I went back a few days later, and the figure was back on the shelf, and the same manager approached me and again asked if she could help me with anything. So I told her nope, but pointed out I was the same guy from a few days before and asked why the bogus product was still out on the shelf. She made up some excuse about how it would be marked down if anyone tried to buy it (but of course the price tag was still full price).
So I've kinda given up on that, although depending on my mood, I might tear off the UPC code so they can't sell it or will acknowledge that it's damaged. I kind of want to get a stamp that says "Swapped Product" that I can just apply to every repack I see, or something...
Not that it's the retailer's fault, but by knowingly selling used, repacked product, they're nearly as bad as the original repacker.
This whole topic just gets me irked, since in my area, there is, as a general rule, more repacked Elite product on the shelves than real Elites. The repacker always snatches stuff up immediately after it comes in, thus ensuring that I pretty much have to order all my Elites online or hope to find them when I'm out of town.
I can't wait to see what sort of Ryback repacks start showing up in the coming months. /sarcasm/

On my old phone I took a picture of a Christian figure inside of a Defining Moments Macho Man package. But I dont have the phone or the SD card anymore. I thought it was funny in the moment, but someone probably for whatever reason bought it.

Walmart has a policy that they will not go after you as long as you take 25 dollars or less worth of merchandise. Apparently it is more cost efficient to let them go then prosecute them and send people after them. oh.... And you have to between 18-65 to be pursued for anything over. It is their new 2013 policy but it has been all over the news so how can you expect them to want to stop this? It never will because according to their policy it is not cost effective to stop it.

For the record, this isn't some "new 2013 policy" because its not policy at all. Stores go after whoever they want whenever they want. Pressing charges costs nothing, and Walmart isn't prosecuting anyone because that's not how courts work. It's been a rumored policy for years but its never been true. They wouldn't tell people about it if it was.

I saw an Elite 11 Punk in an E16 Punk package. I thought about buying it, but the hands had been replaced and it came with the George Steele shirt. All you can do is laugh. I've been saying this for awhile. They are never going to do anything, especially at Walmart. Stop giving yourselves aneurisms saying that they need a team address this miscarriage of justice. Think about this, a team (or even one guy) specializing in wrestling figures for the sole purpose of catching people who return the wrong wrestling figure.

The store does not care. It's an action figure. Wal Mart doesn't care about an action figure or two, and the employees won't care unless it affects their paycheck. Just being realistic.

I suppose it isn't too much to ask for someone to know the difference between a basic and an elite. Even one guy in the shop would be enough. Especially when they have people teaching them the differences.
