I bought a few hats on eBay. All from the same seller, I order 5 but only received 4 of them. I messaged him but there has been no reply. If I open a case, is there a possibility of me winning. Since I bought a lot he shipped the hats in one box and used the same tracking number for all, so now all items appeared as delivered. Am I screwed or can paypal or ebay help me get my money back?

I'd give it at least a couple days for the seller to respond. Might be an honest mistake and they might just be busy or something that they weren't able to reply right away. If you still haven't heard anything after such time, definitely open a case. eBay is generally pretty good about instances like that. Had sometimes similar happen to me not too long ago where only part of what I ordered was sent. eBay closed the case in my favor and gave me a partial refund. I assume they (eBay) then goes after the seller to recoup that money.
Bottom line, if you don't hear from the seller, open a case with eBay. Worst that can happen is they side with the seller, which leaves you right where you are now.

I would give him a week to respond. If nothing after a week, open a case through paypal. They generally side with the buyer from what I've seen.

Wait a few days to reply, and if there's no response, threaten to give negative feedback and open a case if he still doesn't reply. If you still don't hear back, open a case. You'll probably win. Any word back from the seller? Nothing. I sent him another email but he is refusing to respond. If I don't get the missing hat by tomorrow I'll open a dispute. Thanks for the advice everyone. Hopefully I can get a refund for the missing hat. Just file a claim on Paypal, it will at least get his attention. Give him a few days after filing the claim then escalate it so Paypal will look into in and probably just refund you the money.....To start the process log into your Paypal account ant click the resolution center tab and then click dispute a transaction.

I actually ran into that same issue once. My apologies for not mentioning it earlier... It's probably best to actually call eBay in this particular case and explain the situation. Finding the phone number isn't easy though. Here's how...
Click CUSTOMER SUPPORT, then CONTACT EBAY (tab right above 'what can I help you with), then under the BUYING option click ITEM WASN'T AS DESCRIBED, then click the link that says FIND OUT ABOUT OTHER OPTIONS. To the right side of that new page you should see a link for the CALL US option. Click on that and follow the prompts from there to either find get a phone number for customer support.
Why they make it so difficult to actually call and talk to someone from eBay I don't know, but it's there if you know how to find it. Be really adamant about the fact that you tried contacting the seller, but they never replied and tried opening a case, but weren't allowed to do so. Even if it means asking to speak with a manager, do it. Might be an honest mistake on the seller's part, but there's no excuse for not owning up to it and replying to you messages.

Not a problem. eBay's system can sometimes be a pain, but it's worth opening a case. 95% of the time they side with the buyer. At least that's been my experience. As a seller, I had to put up a real stink in order to get an unjustified verdict reversed (it said AS IS right in my ad, even mentioned that the NES I was selling did NOT work properly on three different occasions - buyer opened a case anyway, claiming it didn't work as it was supposed to - eBay sided with them right away and only reversed it when I actually called and had a manager read the listing description).
