Hey guys. I need a second opinion on this situation. I'll be vague, unless you want to know, just PM. I'm 16, my dad has temp custody of me. Do you think I have say so in where I go to live? Keep in mind my mom is in jail for something she really didn't do, as I did. Anyway, could I be able to go live with my grandmother? Any help is MUCH appreciated.

Not unless there's a legit reason like he's a drunk & beats you or something. You can chose between parents but Im pretty sure if its just one parent and a grandparent, friend etc..being under 18 you're stuck with the parent

And to put it very vaguely, he put me in danger once that can with someone's head. So.. Change my chances any?

Your mom is in jail for something you did? Im not judging. She didn't take blame. I tried to. Courts won't hear it. It's not anything illegal. It just is if she did it. If you're wondering, custodial interference.

At that point it becomes a legal battle and your grandmother would have to request you stay with her, plus you'd probably have to prove that your father is in fact an abusive drunk (not saying he isnt but sometimes you need more then just word of mouth). It would probably be easier to catch your dad on a calm sober day and try to sit him down and just tell him you want to move on. Doing the the legal & proper way could be very time consuming.

Oh trust me. I've tried everything from calm to begging and screaming. So you're saying if I do have the evidence (not neccasarily evidence, but a crack in the wall he punched on a drunken rampage) I have a chance?

So you're saying if I do have the evidence (not neccasarily evidence, but a crack in the wall he punched on a drunken rampage) I have a chance? The first step will have to be your grandmother meeting with a lawyer and filing for custody with the courts. There will likely be a hearing, and with your age, the courts will likely listen to what you want and have to say. Although for a father or mother to lose custody to a grandparent, there usually has to be extreme circumstances. Sure, there's a chance, but I would say the odds aren't in your favor unless there is definitive proof that your father is endangering you, or unless he consents to allow custody to her. But nothing can be done until your grandmother files for custody, so the sooner she does that, the sooner the process can start.

Can't you just be emancipated? Don't have a job. You have to be able to prove you can provide for yourself. I tried.

How is court next Monday, if you're just now asking us for this advice? I've actually been on here for like 7 years with different accounts so.. and even if I wasn't just because I wasn't there for a thread it means I can't make a comment about it? Damn didn't know that was a rule on these forums where you can't bring up past stuff if you weren't there

How is court next Monday, if you're just now asking us for this advice? Because I haven't had the time, you know, dealing with depression and all that. You can ask @benurich, I asked him the day it happened.
