In theory with Miz and Swagger, it could be that their pre-existing WWE contract that would be ending, which means they could now renegotiate with either brand. Although the Heath Slater storyline suggests that pre-existing contracts were void as of the draft anyway, because he didn't have a job until he won the belts at Backlash. So it doesn't make much sense.

All that aside, I really don't want Miz going to Raw. He's firing on all cylinders right now on Smackdown. He's a focal point of that show and over on Raw he'll just be another guy taking up air time in the 3 hour and 15 min marathon that is Raw each and every week. Raw already has Owens and Jericho for that style of heel/talker. Smackdown needs the Miz more than Raw does.

Guys its part of the storyline, real life rules get bent to add to a storyline and character development. Personally I think they should keep Miz on smackdown he's more over as a heel right now than he has ever been and his matches are goddamn quality! Having him doing bits with Daniel Bryan only further pushes him as a major heel

Good, have him go to Raw, bring over Owens, Zayn, and Gallows & Anderson and I literally won't have a reason to watch Raw anymore.
The Miz cut an emotional scripted promo, so? The promo wasn't that good, and a flub made it to Botchamania. It just seems like it was good because the guy that has been consistently boring and bad for YEARS, did one decent thing. That promo doesn't erase years of being terrible. And right after that, he went back to being a bland coward, its just now he's a bland coward that cut that promo, so people look at him differently and they shouldn't.
Before this promo, what was he known for and good at? And the Raw after WrestleMania when he won the IC title, what was he known for and good at? And when he was paired up with Damien Sandow and Sandow clearly stole the show, what was he known for and good at? And before that...?
Its like I hear people talking about the Hardyz TNA wacky promos, but not their wrestling abilities. Before the TNA promos, when was the last time someone talked favorably about the Hardyz that didn't involve the Attitude era?

Seriously how is this meant to be a solid split if guys are jumping between shows? Also I thought the contracts were reset since the split so how could Miz and Swaggers already be up?
Are they going to leave Smackdown without a midcard belt?

Moving him to Raw would lose him in the shuffle. Right now they don't know what to do with guys like Neville, Zayn, Cesaro, etc... Miz would be buried under those guys.

I'm sure it's all to the show the rift between Bryan/Miz. Bryan can't stand Miz but he wants the IC title on his show. So he's forced to put up with Miz and sign him to SD for a bigger contract than Bryan feels he deserves.
That being said, I'd be fine with Miz to RAW if it means Cesaro or Zayn to SD.
As for talents switching shows already... It was kinda obvious this would happen. Now the dust is starting to settle, so they can see where talent may be needed more. It's better than having someone drowning on one show, while the other show could desperately need them.

I feel like they just kind of threw the draft together to see how it will work for the first 6 months, without really giving thought to long term. I feel like we really wont have solid rosters till after Mania, with these contract storylines and the Rumble coming up. Its OK as long as they get to the point if solid rosters eventually

So it doesn't make much sense. This is another one of those storylines that hangs out there that kind of bothers me in the back of my mind. If Slater "didn't have a job", why was he allowed in the building and backstage with everyone else? Why was he allowed to come out and wrestle? Suspension of disbelief is tough when you make it difficult to ignore plot holes.
