My reply to Amazon would be to ask what the game plan is to make it right, since it was their screw up. I know they can't get you the figure, but a gift card or something seems to be appropriate. They gave him the money back I mean, that's a requirement. There should also be some form of compensation for my placing my trust in the company to get that item from them. If you sell me a pre-order that you don't actually have or are going to get, you need to do something to make that good. Refunding my money is just basic common sense.. but there needs to be something above that for the time spent, and my potential inability to get that item elsewhere. (I realize thats not the case here, but it often can be with pre-order items)

It's unethical for a company to sell me an item they have no ability or intention of getting in stock. I missed out on the Wooo Edition of WWE 2k this year, despite having pre-ordered it, because the company involved oversold it, despite it being limited to 30,000 copies. I missed out due to someone else's error. When you pre order an item, you're putting your trust in that company to fulfill that order. When they fail to do so, they need to do something to compensate for that trust being broken, IMHO.

I think to expect to be compensated for a cancelled order is typical of what society has become these days, it hasn't cost anything, he got refunded, its clear they were told, as we were, that it was going to be part of the regular elite line, it isnt their fault, at sdcc i believe it was, we were told this and Backlund were regular elites, nobody has lost anything, to expect compensation is ridiculous Things happen, some things happen which are out of the company's control

Went and checked. My "Bob Buckland" Mattel Elite is still there in my open orders. Picture of the figure and all.

I disagree that this fits. If a company doesn't KNOW they are getting the item in stock, then they shouldn't be taking preorders on it, unless it's with the written caveat that it may or may not be available. If I'm gambling, tell me I'm gambling in advance. And sure, in this case, we all know what's going on, but not everyone reads figure forums like we do. If the company made it clear that this was a POSSIBLE thing, I'd agree that nothing should be expected. But that's not the way most of these preorders are set up.

As you said, we have known about this for a while now... but this huge company that does business with this other huge company is just now finding out? That's a serious lack of communication. If someone told me that they could get me X ITEM, and I gave them the money for it and stopped looking for it myself, then two months later they failed to find it.. simply giving me back my money doesn't really cover what our arrangement was.

Wait what? E65 is a WalMart Exclusive? There’s E65 and then there’s Walmart E65 which has Sherri God, I hope not. Making one figure in a set a store exclusive will suck especially around here where the store exclusive usually end up being grabbed up by T0y W!z. Their warehouse is located right behind my local Walmart. And their store is a mile away from both the Palisades Center Target and the Spring Valley Target. And they have people hit those stores (along with a few others) every morning looking for the new WWE, DC and ML figures (as well as other lines) It’s gotten to the point if I see their cars in the parking lot of a store I don’t even go into the store and hope they haven’t hit one of the others first.

Yep, its been confirmed on here a couple weeks back Surely a business isnt going into a store, buying figures and marking them up? Surely toy w1z buy direct from Mattel and other suppliers, i doubt they rely on scooping figures from stores, how would they make any money?
