I just don't understand how WWE could own someone's attire especially if it's there designs. Owen Hart was him and not a gimmik. Yeah so IP is a really funny thing, especially in WWE it seems. For example: Owen Hart was his name, used pre WWE say they can't say they own that. The attire is a "maybe" at this point, it just depends on who came up with the designs: Owen or WWE's designers/Vince at the time. Example 2: prior to copywriting everything, Scott Hall left WWE - obviously he couldn't use the name or wear the gear as WWE came up with all of that. He also couldn't "act" like Razor Ramone, and WCW was sued shortly after his debut due to this. With Owen, it's looking likely that various items are not owned by WWE [with the LOW game being the main example I think so far]. Plus then you have the whole "what are we actually looking at" - Example 3: the OH attire is just letters..........can they copywrite that? I dont think so. Can they copywrite basic "heart" shapes? Again probably not. You could potentially get King of Hearts attire, but not the crown/cape etc. Same with the heart foundation attire, but sans the slammys for obvious reasons And if Owen/his family came up with all the designed himself - then he owns that hands down. My understanding is his wife owns his likeness and everything that came with that. Its a funny one - either way the best thing to do would be to just wait and see what we get I imagine. Well hopefully we can get the attires used in LOW and I'm sure everyone would be happy with that outcome..

I think if there’s even the slightest chance that WWE could sue and win then Jazwares absolutely should avoid doing any of those attires. Their number one priority should be to make sure they don’t f up this deal with Martha. If them making a King of Harts or whatever figure results in WWE making money off Owen then Martha probably voids the deal with AEW and never works with anyone in the wrestling business ever again.

I just don't understand how WWE could own someone's attire especially if it's there designs. Owen Hart was him and not a gimmik. I view it as a character on a TV show. I’m sure Kramer’s wardrobe in protected under Seinfeld’s IP. Someone may be able to obtain Michael Richard’s likeness but if they make a figure of him specific to the look of his character on the show then Seinfeld is gonna sue. I’m sure WWE feels the same way. They consider themselves in the entertainment industry and their programming as episodic TV shows. Bret and Neidhart wore the same attire designs in WCW in 98 as they did WWF in 97. Not sure why WWE would own the rights to Owen’s wardrobe but not family members that are identical. They wouldn’t be able to do a slammy attire, but there’s 0 chance WWE owns a black singlet with a pink Hart logo and some squiggly leg designs aka KOTR or Mania X

This is kind of my thought. It would draw more negative attention than anything else if they got cranky over an Owen Hart action figure being made.

Yeah, they should be forced to relinquish anything Owen related since they killed him.

All I’m saying is that it appears to be a gray area no one is really sure about and we know WWE will likely sue if they feel they have a case. So unless Jazwares is 100% positive that they have the right to make Owen figures using imagery of when he was in WWF then they should avoid those looks. Their first priority should be keeping Martha happy with her decision to trust that WWE will not be making a dime off Owen.

The only thing I heard is that the artist who does the action figure variant covers for the WWE comics pitched Martha and the foundation about making figs and they passed.

Every figure that Storm did of Hogan was based off a WWF or WCW attire. If that wasn't a problem, why would Owen be? I believe AEW now owns the trademark to 'King of Harts' and the hart logo from his singlet is on PWT merch. Hell...Look at some of the attires PWT has done in Micro Brawler form, and there has never been any trouble (other than the couple of guys they had to yank for being under WWE exclusive deals or whatever).

I'm not sure what you mean by a true specific attire, but I know that they couldn't use certain logos. Fortunately Owen seems to have a number of singlets without logos that would be owned by WWE.

That’s because the WWE owns the NWO logo and branding. They don’t own Owens logos (otherwise they’d have pulled down the merch that uses them on PWT)

I'm pretty sure Bret Hart owns the specific Hart Foundation version of the heart/skull/wings logo. He's selling merch with exactly that logo whereas WWE have their own versions of it on their Hitman merch.

If they do make him, that'll be the AEW figure I buy. Do they match up well with Mattel WWE?
