If Randy does return (there's speculation on his back injury that might prevent it) I honestly suspect his actual tats will be altered to break the copyright. Otherwise, yeah, they'll have to muck around with them on the figures. Probably give him something generic. I doubt they will remove them entirely but I can see them inventing fake tattoos just for the occasion. Edit: That said, this case poses a hell of a precedent for future cases. There's something to be said at this point for WWE having to alter EVERYONE's tattoos due to this case. Reading the case, I don't think so. The issue seemed to relate to using the tattoos as a standalone design in the creation suite. So it seems like the issue is dealing with WWE potentially using the designs as merchandise in their own right, as opposed to being on a visual representation of the person. For this example, I wouldn't expect tattoos on the figures to change unless the logos are pre-copy-written (like a logo or etc.)

I honesty think this case is going to serve as a warning to other artists who might be kicking around this idea. I'm not going to debate the ethics of it, because I'm not entirely sure at what point we reach "fair" on this this matter, but financially, you'd have to be some kind of dumb*ss to fight this battle with WWE after seeing the end result.

Agreed. She won. May not have been a lot of money but will 100% set a precedent!! Yeah, it'll serve as a precedent for artists to not even bother going through the hassle of suing. Cause, even if you win, most you'll gain is being able to recover the legal fees. Which is what it sounds like in this instance.

Orton probably paid her more than 4 Grand for all those tattoo's, so she must be gutted about the payout she got. Surely WWE will have something in place with her for using the rights to the tattoo's so hopefully it won't affect things.
However, this is 2022 so nothing would surprise me.

Hard to believe she actually won, but tattoos have long been a legal question of who actually owns them. I have read that in a legal sense, the tattoo artist still retains the right to the original artwork when they tattoo someone, and that the canvas is just paying for the right to wear the tattoos... It's confusing and complicated. I think in this case she was just looking for a money grab. Orton's tattoos consist mostly of generic skulls and tribal designs. He hasn't really used his tattoos in marketing his character, as they would rather use cartoon snakes...
But it makes me think of other wrestlers whose tattoos are more of their identity. How about Brock Lesnar, whose back tat is so iconic that it has actually been used as his logo? And continues to be. Where is that artist? And he has had that tattoo since he was a rookie over 20 years ago.
How about House of Black? They could have a field day with them!

She got less than 4 thousand dollars. With the cost of legal fees and the amount of years this has been going on, she probably lost 5 times that.
Totally not worth it, in my opinion. I guess she proved a point, and this has now set legal precedent for future claims…..but money is usually the bottom line when it comes to lawsuits, and she did not come away with anything worthwhile.

A legitimate artist wouldn’t give a damn and would be happy that their art is getting such a huge stage to be showcased.

Punk has Pepsi and GI Joe logos tatted on him so Mattel and video games just modified them. Mattel and 2K better do the same with Orton. Also, why did the lady wait until 2018 to do anything when Orton has had the majority of his tattoos since way before then? He’s had most of them since what, late 2000s? He’s been in every WWE game for probably the last 15 years at least and has had multiple action figures released. Then what about Orton? He paid for the tattoos. It’s not like he got the tattoos to increase his finances because of her work. Doesn't the Jazwares one have some sort of Pepsi tattoo?

we are getting to a point where lawsuits are REALLY ing ridiculous. a waste of time, energy and money. It all started with an old lady and a hot cup of coffee. This is a common misconception. McDonalds was serving coffee that was way too hot for human consumption and were warned repeatedly. The woman ordered a coffee through the drive-thru and the coffee spilled on her. It fused part of her genitals to her leg. She wasn't asking for millions of dollars, she asked them to cover the cost of her surgery that she needed. McDonalds refused so she sued. It wasn't a lawsuit because she spilled hot coffee on herself, she sued because McDonald's had been warned more than once that they were serving coffee that was entirely way too hot and they wouldn't cover her medical costs.
