War Crime (n.) - Any of various crimes, such as genocide or the mistreatment of prisoners of war, committed during a war and considered in violation of the conventions of warfare. There is no formal declaration of war between the United States and any other country right now. But wouldn't bombing be considered an act of war though?

No...Congress has not signed an official declaration of war. But when the Pentagon was questioned about torture, they said they were following the rules of the Geneva Convention and war when it comes to torture. It's a matter of convience. If something bad happens they can always say "Well it was a police action." It's their cute little way of skirting around things.
