Hi guys -
A few weeks a go, I bought a UFC Unleashed Chuck Liddell figure off a guy on eBay - who is also a member of these forums. I'd already bought the exclusive Kimbo Slice and Silver/Platinum Chuck Liddell figures off different sellers on eBay and shipping (to the UK) was $18 and $20.
He contacted me saying it would cost $49.35(!) to send the figure, so I asked him to check and said usually it's about $20. He got back to me saying the cheapest he could send it was for $35.74. I still thought this was expensive, but took the guy at his word as he seemed honest. He also asked that when I pay, to mark the payment as a gift so he wouldn't have to pay the PayPal fee (which I had to pay instead).
Anyway - when the figure came, I noticed the postage paid/sticker was only $14.20... a bit of a difference from the $35.74 charged! I contacted him, thanking him for the figure, but told him about the difference in the postage and could he possibly refund me the difference (it is against eBay's policy to profit from the postage). I didn't hear back. I left it a week, then contacted him again, saying he seemed like an decent guy and politely asking for a refund of the difference. Again, I've heard nothing.
So what should I do? Am I being unreasonable? Or should I open a case with eBay/PayPal?
Thanks.

Well, since it is ebay's policy, he shouldn't have done it. He should pay you back.

Open a case with eBay and/or PayPal. He f*cked up by getting cheap shipping and charging you $35. It is indeed against eBay's policy to profit from shipping charges, so they need to know about this.

Also, you shouldnt have agreed to pay the paypal fees -> he should have If you mark it as a gift, I'm not 100% sure, but I think the fees are slightly reduced anyway, but always MAKE THE SELLER PAY THE FEES
You shouldnt have to pay anymore than 1. the final listing price 2. the price for postage from their postal office (plus a little due to cost of the packaging), but it is a bit difficult because you won't know the real price until you receive the package. The extra charge they place on it should be no more than the postage they paid for it, plus about $2-4 / £2-3 for packaging AT THE MOST 3. VAT on shipping arriving in your country (very rare though)

you got played, doubt there is anything you can do since you sent the money as gift.

Yeah, the gift thing kind of screwed you. The only way I'll do the gift thing is if I'm getting just a sick, sick deal and I figure I can pay a small premium to get it. For example, I got a Kindle DX (retail $390) for $200 shipped from someone. I did the gift thing because if I'm getting a 50% discount, it's worth paying a small fee for that IMO.

NEVER mark payment as a gift, unless you can 100% trust the guy and NEVER for an ebay tranasction. I THINK you can still open up a case on ebay. Not 100% sure. But, you are ed if you try to go through paypal. You committed fraud, basically. The gift function is only to be used for just that. Thats why you cannot open a case.

Thanks for your comments, guys... This is the ONLY time I have ever marked the payment as a gift - in hindsight it may have been a bit naive but as I said, the guy is a member of these forums (and has 100% feedback) so I thought he would be trustworthy...
I'd have liked to have had some sort of reply/reasoning from him at least - but I'll try opening a case with eBay and see what happens.
