Things like this can happen with a mass-produced product.
Try bringing it back to the shop ad exchange it for another one if they have one left.

Yeah, Mattel has a lot of paint flaws. I've noticed lots of smears and smudges on figures, and random black marks of figures.
I try and inspect the figures as much as I can see of them in the box while I'm in the store before I buy them...but for figures like Brodus who have clothes on and other figures who are covered by something in the box, it's a crap shoot.

That always bothers me when I buy new figures. Doesn't take long before I ignore it though if it isn't a significant amount of chip damage or smear markings along the figure.

That sucks. I'd take one of the other people's suggestion of contacting Mattel.
Personally, since I pose all of my figures, I typically just leave whatever accessories they come with on them. So paint issues like this, unless they are headscan related, typically don't bother me. But to each their own, especially if you use them without the accessories on.

never had a paint problem like that on a figure.
But when one of my figs broke 5 mins after opening it, I called the Mattel # on the back of the elite box. After talking to some chick for a couple minutes I got a $17 coupon from Mattel in the mail. Even made some money selling parts of the broken figure

to me it looks like the track suit was added before the paint dried thus allowing the paint to dry on the material.... for me this wouldn't be a problem because I display all of my figures face forward. and dont use them in for anything other than display purposes' however I'd probably still contact mattel just for the free voucher lol

My E18 Brodus has a black speck on him. Oddly enough it is right where his butt hole is so I left it alone due to the sheer irony and I can't help but laugh.
