You know what’s funny. I told my Son a long time ago that I don’t want to start collecting Lego Dimensions. I told him the only way I would start, is if Lego Dimensions had Marvel characters, so that we can do a Marvel vs. DC battle. HAHA!!

I wouldn't say it failed. I'm sure it made quite a bit of money at one point, but that (unfortunately for Disney) tailed off. Same thing seems to be happening to Skylanders.
But to answer your question, who knows how the licensing rights fall? I'd imagine they will try to work something out, or already have tried and did not succeed.

It didn't really 'fail', Disney is pulling out of publishing games entirely. Infinity is a victim. It was making by far the most money out of any of the TTL genre.

As TheLastDude and slippyfalco said it didn't fail. Disney is no longer publishing console game and focusing on mobile app games.

I wouldn't say it failed, but I would be all for Disney letting Lego use their characters in Dimensions.
