If this argument about tattoos becomes successful where do it end? Can a plastic surgeon claim the same issue and demand royalties for any enhancement work they have done on the female performers? I can understand if the design was trademarked like a band logo, but I cant' imagine that the artist holds the trademark for skulls, roses, and whatever else is tattooed on him.

I hate people who make posts and are to lazy to post the article up and not just the link. Looks like someone here needs a nap. Calm down there hater. If you hate someone who just posts links you must have a HUGE hate list of other things. Why don't you just relax before you have a heart attack.

Unless she specifically designed the tattoos herself and they didn’t come from a book along with her owning the copyright of those tattoo designs PRIOR to Orton getting them, this is absolutely ridiculous

I had someone tattoo a design that an artist in another country did, which one can sue me?

I am an IP lawyer and literally almost every single post I read on here was completely wrong from the actual common law, codified law, and/or even IP-philisophical point of view.
Rather than argue with a bunch of you or post and explain the copyright laws, I'm simply going to say that WWE/Randy Orton will counter that his tattoos were (1) work for hire in which the artist was specifically retained to create the works of art and/or (2) laches apply because she waited too long to assert her claim. Further, Orton selected the tattoos and she did the work under his supervision. Highly unlikely this gets litigated.
For those that claim she doesn't have protectable copyright, you get a common law copyright the second you produce the artistic expression. You can't get treble damages (in a lawsuit) unless you have a federally registered copyright. For those claiming you can't copyright the image of someone's body, go do some research on how people combat revenge porn.

How about intellectual property? Would this also apply here?

Also the first victim of this is my buddy Carlos Condit. He got sued, the UFC got sued, and I believe Yukes got sued. The artist won. It was Carlos's rib tat. The rest were fine. But even UFC 3 is missing only that tat.
