Top WWE Star Claiming He Wants To Sue The Media Date Added: September 02, 2007 Story By: Steve Carrier Source: PWInsider.com
During the meeting before the ECW/SmackDown! tapings yesterday, Batista asked Stephanie McMahon what he could do legally about his name being included in the recent media reports, citing publicly in front of the crew that he had never received anything from the online pharmacy companies. Stephanie told him that was an issue he and his attorneys should look into, also mentioning that she was under the impression he was already doing that (which would mean a civil lawsuit seeking damages).
Batista claims that there was no connection between him and the pharmacies and he is very upset at Sports Illustrated and other media outlets for reporting his name.

Oh c'mon..not like this is going to ruin his image or anything. Besides, it's pretty obvious that Batista has done steroids in the past anyways.

He's trying that old chest nut then is he? allthough considdering Batista is blatantly twice the size of all the other wrestlers that have been accused the media will just eat him alive if he s with them

Batista could sue based on slander if it is proven he is not involved and would most likely win. Actually, it would be libel, not slander. Slander is verbal, libel is written (but otherwise, they're the same basic crime). A couple other things to consider: 1) Libel (or slander for that matter) is very difficult to prove, especially if the information came from a source. In order to win a libel lawsuit against SI, Batista would have to prove two things: A) that the SI reporter KNEW what he was reporting was false and reported it anyway, and B) That the writer did it with malicious intent. Without both of those things being proven in court conclusively, it'll just be a big waste of time and money for Batista. And if the SI reporter included Batista's name because a source told them, then SI can't be blamed for believing the source (but Batista could then sue the source, if he could prove libel against them). 2) Batista really needs to understand what he's getting himself into if he takes someone to court for libel for printing that he had a steroid connection. Win or lose, Batista will probably have to testify under oath about whether he's taken steroids. If he has, but denies it under oath, he'll have to live the rest of his life wondering if his supplier will ever rat him out and provide evidence of perjury, thus opening up Batista himself to being prosecuted for perjuring. All in all, I'm not sure this is a can of worms Batista really needs to open right now. It's not like nobody ever accused him of taking steroids before this SI article, and it's not like a successful lawsuit will stop people from thinking he's on the juice. Why risk it?

In light of all these developments... I am taking the "innocent until proven guilty" approach... So people like Batista, Lashley and Cena are all clean in my eyes until I have been told differently from a reliable source... And I'm sure that to avoid more scrutiny that if either of those three were caught then they would likely get suspended to prove their point...

If he sues Sports Illustrated and he truly had nothing to do with the company he can receive damages for libel. Only if he can prove SI knew the information was wrong and published it with malice. He can't win damages just because SI printed incorrect information... he has to prove they did it on purpose with the intent to damage his reputation. Which, honestly, is not likely. If SI is proven wrong WITHOUT malice, Batista won't win any money. The best he'll get is a published correction and apology.
