Technically not. Its still copyright infringement if Mattel puts the pepsi logo on Punk without permission. Pepsi would be in the right to sue. If you say so, I'm not a lawyer, I could be very wrong. But Pepsi would be stupid to complain.....but in all actuality couldn't all the tattoo artists sue also because that's their work on all these figures? Tattoo artists can sue but I'm talking about the company aspect. You have 2 major companies. When you start having one company use a trademarked logo, such as the Pepsi logo, the other company that ownes the Pepsi logo can sue because they never gave permission for the other company to use their logo. Its all a corporate thing.

Say you make a logo for a massive worldwide company then another company decides to use that logo, that same logo that you made, without permission and make a bunch of money off it and you don't get a dime. Lawyer or not, its not hard to see why they'd choose not to use the logo.

Ok, to clear this all up, Tattoo artists can't sue because they are paid for a service just like designers don't have the rights to logos they are paid to make for a company like Pepsi, but the unauthorized use of a Trademarked item is grounds for a law suit, and by the way this is more of Trademark issue than a Copyright issue but either way hope I cleared it up and we can move on.
