How does mattel get the legends scans. Ive always been confused cause if the legends figure or person is dead how do they get it?

The same way Jakks did. They both use Gentle Giants Studios for scanning.

there is sophisticated software around nowadays which allows creation of pretty accurate 3d computer models from photos. which can then be modified and improved by 3d artists, outputted to wax by 3d printer and given a final cleanup by sculptors before casting for production. i've seen videos on youtube of the photo scanning process. not videos of it being used for figures, but for other things i mean.
i'm guessing mattel and jakks might use a similar method to that in some cases to make their headscans of deceased stars or stars who its impractical to scan due to appearance change or other reasons. or they may just do it all by old fashioned sculpting from photos.
