If it were going to a jury or judge's decision, you are 100% ABSOLUTELY RIGHT! But we're talking about a plea deal here, that's the key. The fact that he had no intention helped their negotiations to keep him from going to jail is my point. You have to keep in mind that's what this is all about. From the straight up "what does the law say", that is certainly correct, but plea deals and negotiated deals work... differently (whether they should or not, is another story). In other words, there is no "building a case to prosecute with" since the two sides are working together on an agreement. A judge has to approve the plea deal. So if the prosecution comes up with a 30 day deal for Jeff and he accepts it. The judge could say no and that he/she won't allow anything less than 90 days in jail for Jeff. If Jeff doesn't like that then he'd have to go for a jury trial. It's up to the judge if the deal is accepted. He certainly could, but I really don't see the judge denying it. All of the judges I know personally certainly wouldn't if the state agreed to it. Again, I do want to repeat that anything is POSSIBLE, this is just what I see as being probable based on what I have seen of this case and prior, similar cases. P.S. I really don't like Jeff Hardy at all lol

if you knew the law like you lectured others about then you'd know the amount itself shows intent, doesn't matter if he says its for personal use, the letter of the law is x amount = intent. since he got caught with x amount, pretty much a slam dunk to prosecute intent. not that i think he's gonna get jail time but don't tell others not to spout out about the case if they don't know the law when you don't seem to know it either. Here we go again. Common sense just cant prevail. If this was someone other than Jeff Hardy, a WFig beloved, the story and opinions would be much different. common sense? i'm just stating what the law states, i didn't write the law so maybe you should talk to those who did about common sense. better yet talk to Jeff and tell him about common sense cause common sense would tell me not to keep a stock pile of illegal drugs in my residence.

I hope he doesn't have to serve much time. Jeff was awesome in the Ladder Match at Against All Odds. He's still got it.

People just want to see Jeff is jail and refuse to listen to any type of reason. He wont goto jail b/c clearly the dude aint distributing and thought of it is as ridiculous as the haters on this board.
