as far as I know if I own something and am not trying to profit it off of it or hurt anyone i can do whatever the hell I want to my phone, however some stores won't activate it but it is becoming commonplace now plus t mobile is owned by at and t now and it's not like your hurting their pocket, just make sure you restore it to factory settings if you get it repaired at apple and dont hate on the kid for not wanting to spend 30 bucks on what could possibly be a scam or worse theirs plenty of places in the mall at the cell phone kiosks that will do it for you for 20 possibly ten if you haggle with them First off, AT&T was forced to back out of the merger. They lost billions of dollars because of this. Second, no one at a kiosk is going to unlock an iPhone for anyone. I work for AT&T and you are to never, ever, under any circumstances provide an unlock code or assist with unlocking an iPhone.

I don't think alot of phone companies can unlock the 4S...as it's done through iTunes. You could try Apple, or check their site and see who they authorize to unlock them. I know in Canada, only Rogers unlocks iPhones (factory unlock) and that's only if you cancel your services with them. You could also try the Gevy sim tray.....it's like 55$ and won't be out for a couple weeks though. Alternatively you can jailbreak it and unlock, but from my understanding, it's a bit of a hassle when new updates come out.

The carriers all treat the iPhone with kid gloves. I remember when the 3GS came out. I wanted one as I was using a dumb phone. I was still under contract with my dumb phone on ATT for another year. I called, yelled at at CSR who agreed to give me the iPhone at the upgrade price, but only if I went to the store. She put this in my record. The store acknowledged that even though their CSR had said that they wouldn't honor it. I told them if they wouldn't honor their agreement (that they agreed had been made) I'd gladly pay an ETF, never do business with them ever again and tell everyone else to not do business with people who will promise things to customers that they have no intention of delivering. ATT told me good bye. They refused to sell one iPhone at a discounted price and would rather lose a customer.
VZW is no better. They used to have a 30 day return policy on all phones. When the iPhone came to VZW, Apple told them that they only way they could get the iPhone is if they changed that 30 day policy to 14 days. VZW folded like a hooker who'd been stomach punched by a pimp.

The only reason why it took so long for the iPhone to get on Verizon was because Verizon wanted to put their bloatware and logo on the phone to which Apple told them to off. Since the iPhone got so popular, Verizon had no option but to cave.

The iPhone 4S isn't Dual Band? That's surprising.
Edit: Just consulted the book of knowledge. The 4S is quad band so it can be an international phone. Crack it open. Does it have a SIM card slot? If so, then it's got GSM capabilities and you can unlock it. Will they let you or help you? Probably not, but you can unlock it.
