They settled over WWE not paying for using his likeness in the Hart Family anthology dvd. No figures or HOF.

...no, they cannot make Owen figures. This pertains to royalties for using his footage and putting him on the cover of DVDs (probably why he wasn't on the cover of the King of the Ring release). A Legends deal or independent contract with Mattel would be required to make the figures. He can't be used in games for this reason, either. Only existing footage/material can be used without signing contracts, with WWE giving Martha (his estate) the royalties.

The lawsuit was what kept them from using his likeness. Now that it's settled, there's no reason to believe that they can't use his image. Unfortunately, the lawsuit was based on the fact that WWE already did use his likeness, when they weren't supposed to. The resolution could be as simple as WWE paid Martha for what they had already done. Until Mattel announces a figure of him, I won't believe one's getting made. I heard these same rumors every year when Jakks still had the license. Personally I think recognition in the HOF should come before any figure.

the article I read said that they are now free to use his name and likeness with martha receiving royalties. thats according to the report wrestlezone posted.

No because that would be new and would need her permission. Owen never had a contract with Mattel to make figures so she would still need to sign off on it. Using footage they already have is fine since that was in his original contract. This wasn't even about footage. A judge said they have the right to use their own footage. This was about using personal pictures they didn't have the rights to and not paying her royalties.

No Owen doesn't have a Legwnds contract so they'd need Martha to sign one. The lawsuit was about the WWE using their own footage of Owen.
