This will be a long post so I apologise in advance. Me and my friends booked up to go to Las Vegas in August a couple months ago. I decided to get everything out of the way early and do my ESTA, however I answered yes to the question asking if I had ever been arrested or cautioned. I answered Yes because back in 2008 on a night out someone took my phone, and after arguing I punched the person in question. A police officer saw and arrested us both, I proved I had been stolen from but still had to spend the night in the cell. The next morning I was questioned again and they confirmed what was said the night before and so I was let off with just a caution with no fine or sentence. Because of this my ESTA was denied, so after being in contact with them I now have to go to the Embassy in London (I'm from Sunderland area) to apply for a non immigrant visa. My appointment is in 2 weeks and I have all my relevant documents, police certificates and ID etc, I was just wondering if anyone on here has been in the same situation and know what my chances are? I'm fairly confident of being accepted for a visa as surely such a small offence 7 years shouldn't be serious enough to deny me access to USA? I've read about and it sounds like if I had just originally answered No on the ESTA it would have never been an issue and I would have passed through security without question.

The U.S. will be welcoming a similar convict in Steven Gerrard with open arms in a few months for an even longer stay, idk why you're having such a raw deal with it, personally.

Yeah, best thing would have been to say no, but you should be fine. At least you're going to have a couple of months for everything to come through, the internet's full of horror stories of people who do this like a week before they're meant to be going and can't get it sorted in time.

First of all, yes, you should have just said no because you weren't charged and don't have a conviction. I'd imagine you should be fine once investigated and with it being such a long ago too. I think I have something similar on my record (not my fault of course) Best of luck to you I'm from Sunderland area too

Hi mate. This July will be my sixth summer in a row in Vegas, and yes they do take it seriously. My pal with a colourful past was pulled in at passport control. They asked him what his record is. Class B weapons charge. It sounded really serious, and he was in a room with a Chinese traveller who had guns being pointed at her head. Only when they found out that it was for CS gas, they told him to get the out. They can buy pepper spray over the counter!!!

Thanks for the feedback, seems my honesty is causing me some unnecessary hassle and expense. Least I can have a day around London haha.

If you have been arrested in the UK even if your not charged which leads to conviction you have to declare this and therefore your ineligible under the vwp. The above means you wouldn't pass an Esta, therefore you have to get a police certificate and fill in another form and I'd imagine present yourself at the US embassy in London for a visa appointment. Thought id just post a little update. After about 4 hours waiting in the embassy I finally got seen to and my Visa was approved! Just had something to eat and had a stroll round Hyde Park. Just at Kings Cross waiting for the train home

Thought id just post a little update. After about 4 hours waiting in the embassy I finally got seen to and my Visa was approved! Just had something to eat and had a stroll round Hyde Park. Just at Kings Cross waiting for the train home When you think about it, if you tell a white lie, you save yourself a fair bit of money and all the jumping through flaming hoops you have to do. Telling the truth costs really. But then again peace of mind is that nothing will bite you on the ass when you get to the USA.
