So I've been looking for a job really seriously for the last month or so. I finally got a job offer that I'm mulling over, but I really don't know if I want to accept it or not and I'm looking for some input.
First of all, I hate my current job. The reasons don't matter, but it's not in my field and I don't like working there. It does pay well though the hours are very weird sometimes.
The place that offered me a position offers regular 8-5, M-F hours. You get holidays off, but they come out of your vacation pay that you accrue. The pay is about $5k less a yr than what I'm making now, but I would have a chance to move up. The biggest problem I see is the non-compete agreement they want you to sign. It basically says that if you leave the company you won't work for any of their competitors for 3 yrs. A competitor (per the agreement) is a company or individual engaged in marketing computer hardware, software, or services to the general public and/or business community. To me that's pretty broad so I'm kind of scared.
What do you guys think?

Keep looking. If you were to take this job, and find something better later, you'd be kicking yourself in the ass.

Well, there is something to be said for having regular hours. I know at one point I sacrificed money for that, and was very glad I did. I will say that most non-compete clauses don't hold up in court, and odds are they won't enforce them, unless you are actually in the software development and could give their competitors that sort of information.

I called my states department of labor today. They said there are no hard and fast rules on non-competes here in KS. I guess I'll try calling some lawyers tomorrow and see if I can't finagle some free or cheap advice. I don't want to be tied down to the same company for the rest of my career right now. A non-disclosure agreement is in there too and I don't have a problem with that. The non-compete is making me hesitate.

Ask if you can sign it under duress. You might then have a loophole for the future.

In most cases they won't even bother enforcing the non-compete clause unless they feel you are a direct threat to their companies well being ie-access to to information they wouldn't want competition to know, or could bring a good chunk of business along with you, or if you were to start up a business in direct competition with them. Just....try not to list the company who made you sign a non-compete clause as a reference.....

yea id look around a little bit. it always seems that once you settle that job you really want suddenly pops up and youll be regretting it for a long time

To be honest i think you should keep looking. There are too many restrictions in that new job. I don't think you should settle for it, you should push your luck further and look for other jobs unless you can find a loophole which you know will definately work.

I've never heard of your holidays coming out of your vacation time you earn. I'd keep looking, their terms are iffy to me. But ultimately it's your choice, if you think it all sounds good and you can make a good living at it, go for it. On the other hand, you're questioning this job, which might mean you shouldn't take it.

I advise you continue looking.
I left a job once cos the hours were crap, and i went to a different job that had fine hours, but was generally much stricter (and offered less money).
I regretted it. I know for a fact that you will, too. You'll always be thinking at the end of the week "I shoulda stayed in the last job. sure, the hours sucked, but at the end of the week it'd be over and done and i'd have some more money, money, yeah, yeah."
And then you'd dance around to Cryme Tyme's music.
But you would likely regret it.

Well, I remembered that they re-imburse for mileage at the new place. But I'd have to drive 30-40 miles a day (which doesn't sound that realistic to me) in order to make the money I make now.

Its all about the hours for me. I work M-F 8 to 4 for less money but it is worth it. Take less money for better hours everytime.

I remember when I signed my current employee contract, it had verbiage regarding not working for competition.
I asked about it - and they said it didn't matter what I did after I left, but I couldnt work for the competition during my tenure with the company. It also had many other Non-Disclosure pieces as well...
I'm very happy with the company, have been there over 2 years now, and have been promoted a few times.

Well, I called him and declined the job offer because of the non-compete clause. It's really the only thing I don't like about the company. He seemed understanding enough and didn't seem all that surprised. I guess I keep looking and working the job I don't like. I kind of hoped this would be it though. I guess it wasn't meant to be.

Well man, if i were you i'd apply to all of the places they considered "competition" and try to get out of the job you dont like. But remember it could always be worse you know.
By the way, didnt you use to work in law enforcement or something? or did you just say that before messing and i believed you?

I'm in a similar boat, job hunting, but I will not sacrifice my hours. Granted, in manufacturing, there's not much outside the morning to mid-noon schedule, M-F, but I'm wary.
