Considering Amann is stating Punk never even came to him about a lump, Punk has to prove more than just he got it removed by somebody else. Good luck with that. If this is a defamation/libel/slander lawsuit, the burden of proof is on the plaintiff. Doesn't he need to prove that (A) Punk was deliberately dishonest about the facts, (B) that he meant to defame the doctor's character, and (C) that the doctor was actually harmed by the statements (i.e. loss of income/future earnings, tangible damage to reputation, etc)? I don't think, if by some craziness that this went to trial, they would ask Punk to prove something that took place between just he and the doctor? I can tell you for a fact that Punk had a gross-looking lump on his back because I saw it on TV. I do see where there are some holes in Punk's version of events (like the 2nd or 3rd incident he mentions where he discussed the lump with the doctor... it doesn't make sense/wasn't clear to me how that conversation ended), but if Punk can produce some sort of documentation that shows that he had a pretty significant procedure done within weeks of leaving the company, I think this thing probably gets dismissed. I'm not a lawyer, so I'll admit I figured the burden would be on Punk who was claiming what is essentially malpractice. The bottom line, though, is it's probably really easy for Amann to prove his rep took a hit. Look at this thread alone. Filled with Punk marks who hate the guy based solely on the words of one wrestler. I'm sure he could get some evidence for that claim fairly easily, even if it won't all be credible, some of it might be. I don't think it would get dismissed in that case. Punk did say that Amann gave him antibiotics for a concussion, I would think if that's true, there should be some sort of record kept, no? It's a mess, and I'm sure the truth is somewhere in the middle (though I'm not sure what the middle would look like here). I would have no problem believing Punk made up bullcrap, but like I've stated (and people refuse to acknowledge before attacking me), I'm sure the truth is some sort of middle ground exaggeration that got blown out of proportion. Edit: And by the way (not to you, Batfleck, in general) I'm more than happy to discuss craplike normal. I'm not a fan of people attacking me because I claim to have friends who worked on shows with somebody. It's a big  ing independent scene, there's a lot of ing people in it. I suggest, before you question what I say, and insult me like a mental midget, to read what I actually post and provide some sort of intelligent debate, or comment. Getting threads locked because I have to back up and justify every single post I ever make is ing stupid. |

You're the one throwing out claims about Punk's character based on what you know about him through other friends who worked with him in Japan and ROH, yet you're not willing to elaborate on any of your claims. If you don't want to go any further in elaborating on it when someone asks you a follow up question, what exactly was the point of you even bringing it up to begin with? Just so everyone here can know that you have friends who worked with Punk? If you read the thread, you wouldn't ask dumb questions. Someone asked me how I can question his character, and I responded by saying I have several friends who have worked with him, none of whom have ever had a single positive thing to say about him as a person. It's pretty well ing known he's an bunghole, not sure why it's so hard to believe that. When I question a person's character, I also question their honesty. Whoa whoa whoa whoa...pump the damn brakes.... So this week, we all like Punk right? Cause when he was gone but under contract we loved him, then when he was released and going to the UFC we laughed at him and said he was overrated. Then he made statements and he was just a bitter washed up wrestler and now he's getting sued and he has a case cause the doctor is crooked.....so, we're Pro Punk this week right? Well...2 more days until next week and we can be Anti-Punk THE MORE YOU WFIGS!!!!!! |

I would assume there is, but I have no idea how that stuff works with WWE... how regulated it is and how important WWE feels it is to keep those records. Do you think Punk is lying about getting Z-paks? Not being argumentative, just wondering what you think. If he never prescribed them you'd think the doctor could prove that. I don't know if he would administer that sort of medication himself or if he just writes a prescription for it to be filled at a pharmacy. I agree that Punk's version of the story probably isn't 100% accurate, but I tend to believe most of what he said... Punk seems like he's generally a straightforward guy but if he is lying about the stuff that pertains to the doctor, he absolutely deserves to get sued. |

I have friends who worked with him in ROH and IWAMS. I know enough about him. I respect that. But story or opinion is not enough to make a deduction about the quality of a person. Never met him but I will safely say Chris Benoit wasnt Father of the Year. |
